In Alabama, workers’ compensation insurance is required for businesses with five or more employees. However, it’s recommended as soon as you hire your first employee to help protect your business and your team.
In Alabama, workers’ compensation insurance protects both your employees and your business if an employee is injured on the job. Without coverage, you could be responsible for medical expenses, lost wages, and legal costs out of pocket. With the right coverage in place, you reduce financial risk while helping ensure your employees receive the care and benefits they need quickly and fairly.
Audits
Yes. Final audits can be completed and submitted securely through the Member Portal. This feature provides greater security, reduces paperwork, and saves you valuable time.
To complete your online audit, you will need the following information and documents:
- Breakdown of actual payroll by classification.
- Annual gross income for all officers, along with the appropriate classification code for each officer. (See the question below for more information about what is included in annual gross income.)
- State quarterly SUTA reports for the coverage period (all pages must be uploaded through the Member Portal).
- Internal payroll reports for the audit period (must be uploaded through the Member Portal).
- All 1099 forms issued, along with the 1096 form and certificates of insurance for all subcontractors (must be uploaded through the Member Portal).
- Any changes that occurred during the audit period, including changes in ownership, business operations, partners, executive officers, locations, entity type, or contact information.
Total gross salary and wages include all forms of payroll, including salary, wages, overtime, commissions, draws, bonuses, 401(k) contributions, cafeteria plans, 403(b) contributions, holiday pay, vacation pay, sick pay, piecework, jury duty, and other compensation. Include payroll for all employees who perform the same type of work and report the total under the classification that best describes the work performed. Overtime wages and tips should also be included in the actual wages column.
Please refer to our Online Audit Steps guide for detailed instructions on completing and submitting your audit through the Member Portal.
Claims
Please fill out the Member Portal Access Form.
Claims may be filed by logging into the Member Portal or by completing the First Report of Injury (FROI) and submitting it by email to [email protected] or by fax to 334-215-8480.
A claim should be filed within 24 hours of the employer receiving notice of a workplace injury. Notice is considered received when a supervisor, manager, safety director, or other representative of the employer becomes aware of the injury.
In Alabama, the employer may direct the injured employee’s initial medical care. Employers should designate an approved medical provider and follow a predetermined medical protocol for workplace injuries. Personal physicians should not be used unless approved under the workers’ compensation claim. If you need assistance locating a provider or establishing a medical protocol, contact our Claims Team or 334-215-8234.
Temporary Total Disability (TTD): Paid when the injured employee is completely unable to work. Benefits are based on two-thirds (66 2/3%) of the employee’s average weekly wage for the 52 weeks preceding the injury.
Temporary Partial Disability (TPD): Paid when the employee returns to restricted duty that results in reduced wages.
In Alabama, indemnity benefits are subject to a 3-day waiting period. The first three days an injured employee misses work due to a workplace injury are not paid unless the disability lasts more than 21 days. If the disability extends beyond 21 days, benefits for the initial three-day waiting period become payable.
If an injured employee is released to restricted or light duty, the employer may return them to work in a modified capacity when appropriate. AlaCOMP strongly supports return-to-work and light-duty programs and partners with vendors who can identify off-site light-duty assignments when an employer is unable to provide one. Your claims adjuster can help determine the best option for your situation.
Only the insurance carrier can deny a workers’ compensation claim. A claim may be determined to be non-compensable for a variety of reasons under the workers’ compensation policy. If there are questions about compensability, your claims adjuster can review the circumstances of the claim and explain the decision.
A medical protocol outlines how workplace injuries and illnesses should be reported, evaluated, treated, and managed. It helps ensure employees receive timely, appropriate care while promoting consistency, controlling costs, reducing recovery time, and supporting a safe return to work. View an Example Medical Protocol or download the PDF Fillable Medical Protocol.
A medical protocol helps ensure workplace injuries are handled consistently from the moment they occur. It provides clear direction for reporting injuries, obtaining appropriate medical care, and supporting an employee’s recovery and return to work. A well-defined protocol can also improve communication, reduce costs, and help create a safer workplace.
Complete the First Report of Injury (FROI) for the state where the injury occurred, provided that state is the employee’s normal work location. You can find all out-of-state FROI forms above and on our Forms page. If you have questions, contact Matt Graham for assistance.
No. Out-of-state claims cannot be submitted through the Member Portal. Instead, complete the appropriate state-specific First Report of Injury (FROI). You can find all out-of-state FROI Forms above and on our Forms page. If you have questions, contact Matt Graham for assistance.
